EDA Consortium Referral ServiceLitigation has been the typical means of resolving
commercial disputes when the disputing parties cannot come to terms on their own.
However, litigation involves considerable expense, and because of its adversarial
nature, can take years to come to resolution. Many commercial disputes are now
being resolved through the use of Alternative Dispute Resolution ("ADR")
methods such as mediation and binding arbitration. Mediations are held before
a neutral mediator, who hears arguments for both sides and helps negotiate a mutually-agreeable
resolution to the dispute. Compared to traditional litigation, mediations are
less costly, more efficient and quicker. The EDA Consortium is pleased
to provide its members with information and access to one of the preeminent ADR
providers in the United States, JAMS. JAMS success starts with their neutrals.
The JAMS neutrals have a reputation for their ability to see clearly through difficult
situations, put them in perspective and resolve matters quickly. They pride themselves
on staying fully informed about all areas of the evolving social and legal environment:
what's changing, and what effects, if any, these shifts have on your disputes.
The JAMS neutrals have chosen to practice ADR full-time and only at JAMS, serving
as mediators, arbitrators, private judges, facilitators, special masters and referees.
Their collective efforts result in a high degree of professionalism and resolution
of almost all of the cases mediated. The world's top judges and attorneys have
chosen JAMS as their ADR environment because they provide unsurpassed support
teams and case management service. JAMS case managers begin the handling of your
case by gaining a precise understanding of the nature and complexity of your dispute
and the issues and personalities involved. They will then design a process that
meets the needs of all parties and foster a fast and efficient dispute resolution.
Their case managers excel at getting parties to agree on a neutral, procedure,
location and date - all with a unified agenda of gaining resolution. The EDA Consortium
has no affiliation with JAMS, and will not be involved in any manner with the
resolution of any dispute. As a service to its members, and the EDA community
at large, the EDA Consortium has helped arrange for the creation of a panel of
neutrals at JAMS who will be dedicated to the resolution of commercial disputes
in the EDA industry. The EDA Consortium may provide training to the EDA panel
on the issues and standards important to the EDA community, so that they may become
more knowledgeable, more able to consistently resolve commercial disputes for
the EDA industry. For more information, we encourage you to visit JAMS website
